Fortieth Congress of the United States of America; 
At the third Session, 
Begun and held at the city of Washington, on Monday, the seventh day of December, one thousand eight hundred and sixty-eight.

A RESOLUTION 
Proposing an amendment to the Constitution of the United States.

Resolved, by the Senate and House of Representatives of the United States of America in Congress assembled, (two-thirds of both Houses concurring) That the following article be proposed to the legislatures of the several States as an amendment to the Constitution of the United States, which, when ratified by three-fourths of said legislatures shall be valid as part of the Constitution, namely:

Article XV.

Section 1. The right of citizens of the United States to vote shall not be denied or abridged by the United States or by any State on account of race, color, or previous condition of servitude -- 
Section 2. The Congress shall have power to enforce this article by appropriate legislation. --

A resolution by the Georgia state legislature to ratify the Fifteenth Amendment, February 2, 1870.

Following the Civil War, African Americans had already already claimed voting rights and elected black representatives to Georgia’s constitutional convention and the newly constituted state legislature in 1868. However, white Republicans and Democrats in the state assembly soon allied to expel all the black elected officials. Congress responded with military oversight and, by January of 1870, re-seated the black representatives a month before this ratification was issued. Georgia was the second to last of the required number of states to recognize the fifteenth amendment in order to secure its ratification. Iowa was the last required state, ratifying the amendment the following day, on February 3, 1870. Adoption of the amendment was required before Georgia would be re-admitted to congressional representation. Georgia was the last Confederate state readmitted to the Union.

Lyrics for “The Fifteenth Amendment” by African American songwriter Joshua McCarter Simpson. 

Born free in Ohio, Joshua McCarter Simpson was an African American abolitionist, herbal doctor, Underground Railroad conductor, and songwriter. Simpson studied at Oberlin College and published his songs in a collection titled *The Emancipation Car: Being an Original Composition of Anti-Slavery Ballads, Composed Exclusively for the Underground Railroad* (1854, 1874).


An excerpt from a speech by Henry McNeal Turner in Macon, Georgia on April 19, 1870 regarding the benefits of the Fifteenth Amendment.

Henry McNeal Turner was a religious and political leader among Georgia’s African American community during Reconstruction. Turner served as a chaplain to black regiments during the Civil War and was elected to Georgia’s state assembly as a representative in 1868, though he and other other black elected officials were soon expelled from their seats by white Republicans and Democrats.

A letter from April 1870, written by Samuel May to Richard Davis Webb, mentioning Boston’s celebration of the Fifteenth Amendment. 

Samuel May was a white abolitionist and minister from Massachusetts. He worked closely with William Lloyd Garrison and his circle of abolitionists and as an agent of the Massachusetts Anti-Slavery Society for many years. May’s cousin, Samuel J. May, and Wendell Phillips were also Garrisonian abolitionists. Richard Davis Webb was an Irish journalist and abolitionist.

Dear friend Webb, 
I am indeed delinquent in my correspondence, not with you alone, but (I fear) many - certainly, some others. And, even now, I have not the time to explain or apologize, -- of which you will doubtless be glad! To-day the citizens of Boston are celebrating the adoption of the “Fifteenth Amendment” ~ all the colored people of the city + of many neighboring towns also, and a good sprinkling of white folk beside; the day is warm + bright, + all is auspicious. At 3 o’clock. Faneuil Hall will be well filled, maybe packed, + Garrison, + Phillips, + numbers of others, are to speak. S. J. May and I, in this family, are honored with tickets of invitation to platform; and as it is now past 2 o’clock, you will perceive I have small time for writing. But I have no sinister motive in so long a silence, as I’m sure you’ll believe.

We are very sorry to have Deborah leave the country without coming to Boston, or Leicester, again. We comfort ourselves a little with sending you a few books now, and hoping that both you and she will, before long, visit America again.

I had a short note from Mary Erthin[?] yesterday, ~ written with her left hand. She said she had sent to you, some weeks time, a letter I had written to her, concerning Mrs. Robbins’s death mainly, + my father’s illness; -- and, before I had finished which, my dear father himself joined the great company of the departed. -- I was glad she sent it to you; for I quite had you in mind, all the while I was writing it. A portrait of Octavius Catto, an African American activist, educator, and political organizer, ca.1871.

In addition to his work as a political organizer and educator, Catto worked with Frederick Douglass as a recruiter for black regiments during the Civil War. Catto was a supporter of the Republican Party and an advocate for the Fifteenth Amendment. Although Pennsylvania was a free state prior to the Civil War, African American men’s right to vote had been rescinded by the state legislature in 1838. For the city’s first election following the Fifteenth Amendment, Catto led a campaign encouraging Philadelphia’s African American community to vote. On election day, Octavius Catto was shot and killed by Frank Kelly, a Democratic Party agent. 


An excerpt from a pamphlet called *The Trial of Frank Kelly For The Assassination and Murder of Octavius V. Catto, on October 10, 1871*.

Frank Kelly was a Democratic Party supporter who killed Octavius Catto, a black political organizer, on October 10, 1871. Following the shooting, Kelly fled Philadelphia and was found six years later in Chicago. He was returned to Philadelphia for his trial, which was recorded in this pamphlet. Despite testimony by six eyewitnesses who identified Kelly as the perpetrator, he was acquitted.


An 1869 broadside in response to the proposed Fifteenth Amendment, titled “Republicans! Democrats! A Word with you about Negro Suffrage.”

This broadside is signed Oliver Ellsworth. Ellsworth (1745 to 1807) was a “founding father” who helped to draft the US Constitution, served as a senator from Connecticut, and was the third Chief Justice of the United States Supreme Court. The creator of this broadside likely used Ellsworth’s name as a pseudonym.

Hiram Revels, the first African American US senator, took Confederate President Jefferson Davis’ seat, representing Mississippi, on February 25, 1870. The other congressmen pictured include Representatives Benjamin Turner of Alabama, Robert DeLarge of South Carolina, Josiah Walls of Florida, Jefferson Long of Georgia, and Joseph Rainey and Robert B. Elliot of South Carolina. The Forty-First Congress met from 1869 to 1871 and the Forty-Second Congress met from 1871 to 1873.


An excerpt from a 1905 essay by A. H. Grimké called “The Meaning and Need of the Movement to Reduce Southern Representation.”

*The Negro and the Elective Franchise* was a collection of essays and a sermon published by the American Negro Academy in 1905. The American Negro Academy was an organization of black scholars and intellectuals that operated from 1897 to 1924. Archibald H. Grimké (1849-1930), author of this essay, was born enslaved and was freed as a result of the Civil War. Grimké was the president of the American Negro Academy from 1903 to 1919.

Poll taxes were laws that required payment of a fee in order to vote, and were implemented in southern states like Tennessee in order to restrict the political power of African American communities. By the 1880s, Tennessee began enforcing poll taxes, which remained active until the 1960s. In many places, poll taxes were combined with other voting restrictions such as literacy tests.

**Free The Ballot** 
America is not fully free so long as the ballot is fettered in any part of the United States of America. The right of the Negro citizen to vote is embedded in the Fifteenth Amendment of the federal constitution. In a number of states the right-to-vote amendment has been frustrated, negated and butchered. 

In the South there is only token Negro voting on an average basis. In a number of Southern counties with more Negro citizens than white citizens there are no Negro voters. This is a tragic commentary on American democracy. Excuse given for such racial denial of voting is the preservation of "white supremacy" and to prevent "Negro bloc voting". The bogey of "Negro rule" and the preservation of "white rule" are other scares. 

Still much is said of "States' Rights" and "local rule." Yet local rule should be based upon the rule of the local people. States' rights envision a respect for personal and individual rights. Southern politicians tend to distort the theory of states' rights and to misapply the idea of local rule.' 

The Fifteenth Amendment bestows upon the Negro citizen a right which constitutionally cannot be removed by state action or states' rights doctrines. Yet that very thing is being done in the South and the Congress has been indifferent and laggard about using its authority and power to protect, guard and actuate the Negro citizen's right to vote in the South.

A number of bills have been introduced in the Congress seeking to implement the Fifteenth Amendment. The Republican Administration and the Democratic Majority Leadership together with individual lawmakers have submitted bills designed to make voting rights practical opportunities for the Negro group. Introduction of bills, press releases about them and the criss-cross of quibbling partisan criticism, do not always produce legislation.

Therefore if the President of the United States actually means that he is for meaningful voting by the Negro group in the South he is going to have to begin to fight with all of his power for such legislation. He probably will need to carry the fight to the people in a special nationwide civil rights speech. We would like to see President Eisenhower carry the fight for practical voting opportunities to the people and exert bold and uncompromising leadership for the right to vote. 

In the meantime, those who want Negro voting opportunities established and materialized in the South should build a fire under Congress. A hard fight is a hand and the Southern lawmakers in Congress are tough, skilled and experienced counter fighters, let Congress have no peace of mind, no easy conscience and no happy time at the polls until adequate civil rights legislation is passed in the current session.

Activity

1. Have students stage a mock meeting of the American Negro Academy based on essays in *The Negro and the Elective Franchise*. Students can select specific members of the academy and research their lives and perspectives. At the mock meeting, students can discuss and debate strategies and ideas for securing the full promises of the Fifteenth Amendment.
2. Have students create collages inspired by the commemorative prints at the beginning of the set. What would the scenes and imagery for a “Fifteenth Amendment” print have looked like in 1905? What about in 1965? Students can research historical images from DPLA and other sources to complete their “vignette” collages.

Overview

The Fifteenth Amendment to the US Constitution, ratified on February 3, 1870, says that the right to vote cannot be denied or abridged on the basis of race, color, or prior condition of servitude. The Fifteenth Amendment is often grouped with the Thirteenth Amendment, ending slavery (1865), and Fourteenth Amendment, securing citizenship (1868), as one of the “Reconstruction amendments,” which were passed by the radical Republican-dominated Congress following the Civil War. In effect, the Fifteenth Amendment secured the right to vote for African American men. As many as one million African American men registered to vote throughout the South, where in many districts African Americans constituted the majority or near-majority of the population. This expansion of political power also resulted in a dramatic increase in political representation as African American men were elected to local, state, and federal offices throughout the North and South. 

Many of the gains provided by the Fifteenth Amendment proved to be only temporary, however, because many white Americans strongly opposed black political power. Following the end of Reconstruction, many southern states quickly enacted laws that limited the voting power of black citizens in order to restore white supremacy. In some places, African Americans faced additional taxes or the threat of losing their jobs, homes, or even their lives if they tried to vote. By the 1890s, most black communities in the South were effectively disenfranchised by these state and local policies, despite the Fifteenth Amendment. During the 1960s, securing equal voting rights became one of the central issues of the civil rights movement, culminating in the Voting Rights Act of 1965. The documents, images, photographs and articles in this set explore the passage of the Fifteenth Amendment, responses to it across the United States, and its long-term impact on the struggle for equal voting rights.
