This collection uses primary sources to explore the invention of the cotton gin and its impact on cotton production and the expansion of slavery in the United States.

Cotton plants produce a single stem that grows to be three to four feet tall on average when cultivated in rows. From this stem, offshooting branches host blooms that become bolls—protective cases that hold seeds wrapped in cotton fiber. The coarseness of the bolls can damage the hands of cotton harvesters picking by hand. To get cotton fiber that can be made into textiles, the seeds need to be removed.

Inventor Eli Whitney developed this model for the cotton gin and applied for a patent in 1793, though others quickly pirated his invention. Whitney’s cotton gin used rotating brushes and teeth to remove the seeds from cotton. Southern plantation owners depended on enslaved people to cultivate and harvest labor-intensive crops such as rice, sugar, tobacco, and especially cotton. As the market demand for cotton increased in the early 1800s and the cotton gin made cotton processing faster and easier, the Southern cotton industry expanded dramatically, as did the system of slave labor on which it relied.

The first page of this contract is a typed transcription and the remaining pages are the original handwritten contract. The contract gives the State of Tennessee patent rights to Eli Whitney’s cotton gin. After his invention, Whitney did not envision selling patent rights to his design. Instead, he planned to charge farmers fees for using gins that he built to process their cotton. But planters in Georgia where Whitney developed the gin began making their own versions and claiming they were "new" inventions. Struggling to turn a profit and bogged down by legal battles, Whitney and his partners agreed to license gins. In 1802, South Carolina agreed to purchase Whitney's patent right and North Carolina and Tennessee followed. Catherine Miller and Phineas Miller, mentioned in the contract, were a married couple who supported Whitney’s invention and invested in his cotton gin business. The Millers were neighbors of the Georgia plantation where Whitney was a tutor when he built his first cotton gin model. Phineas Miller died before this contract was created.

In this petition to the US Congress, titled as a “memorial,” Eli Whitney makes the case for the renewal of his patent for a cotton gin. He narrates the history of his invention, patent, and subsequent legal challenges. Whitney applied for his original patent in 1793 and he received it in 1794, but it was not validated until 1807. Because of a loophole in the 1793 patent act, Whitney and his partners could not collect any money from their lawsuits against copycats until the law was changed in 1800 to allow for the awarding of damages for patent infringement. Congress did not approve this request to renew Whitney’s patent in 1812.

Transcription: 

To the Honorable the Senate and House of Representatives in Congress assembled, 
The Memorial of Eli Whitney 
Respectfully showeth,
 
That your memorialist is the inventor of the machine with which the principal part of the Cotton raised in the United States is cleaned & prepared for market. That being in the State of Georgia in the year 1793, he was informed by the planters that the agriculture of that state was unproductive, especially in the interior, where it produced little or nothing for exportation. That attempts had been made to cultivate cotton: but that the prospect of success was not flattering. That of the various kinds which had been tried in the interior, none of them were productive, except the Green seed cotton, which was so extremely

difficult to clean, as to discourage all further attempts to raise it. That it was generally believed this species of cotton might be cultivated with great advantage, if any cheap and expeditious method of separating it from its seeds could be discovered—and that such a discovery would be highly beneficial both to the public and the invention.
 
These remarks first drew the attention of your memorialist to this subject and after considerable reflection he became impressed with a belief that this desirable object might be accomplished. At the same time he could not but entertain doubts, whether he ought to suffer any prospect of so precarious a nature as that which depends upon the success of new projects to divert his attention from a regular profession.
 
About this time Congress passed a new Patent Law, which your memorialist

considered as a premium offered to any citizen who should devote his attention to useful improvements and as a pledge from his country that in case he should be successful, his rights and his property would be protected.
 
Under these impressions your memorialist relinquished every other object of pursuit and devoted his utmost coercions to reduce his invention, which, as yet was little more than a floating image of the mind, to practical use—and fortunately for the Country he succeeded in giving form to the conceptions of his imagination and to matter a new mode of existence and the result of this new modification of matter was everything that could be wished.
 
After reducing his theory to practice by effectual and successful experiments your memorialist took out a patent.

So alluring were the advantages developed by this invention that in a short time the whole attention of the planters of the middle and upper country of the Southern States was turned to planting the Green Seed Cotton. The means furnished by this discovery of cleaning that species of cotton were at once so cheap and expeditious and the prospect of advantage so alluring that it suddenly became the general crop of the country.
 
Little or no regard however was paid to the claims of your memorialist—and the infringement of his rights became almost as extensive as the cultivation of cotton. He was soon reduced to the disagreeable necessity of resorting to courts of Justice for the protection of his property.
 
After the unavoidable delays which usually attend prosecutions of this kind

and a laboured trial, it was discovered that the Defendants had only used—and that was the law then stood they must both make and use the machine or they could not be liable. The Court decided that it was a fatal, though inadvertent defect in the law and gave judgment for the Defendants.
 
It was not until the year 1800 that this defect in the law was amended. Immediately after the amendment of the law, your memorialist commenced a number of suits but so effectual were the means of procrastination and delay, resorted to, by the Defendants, that he was unable to obtain any decision on the merits of his claim until the year 1807—not until he had been eleven years in the Law and thirteen years of his patent term had expired.
 
A compromise has been made with several of the States to which your memorialist has assigned his right and relinquished all further claims; but from the state in

which he first made and introduced his invention, and which has derived the most signal benefits from it, he has realized nothing—and from no state has he received the amount of half a cent per pound on the cotton cleaned with his machine, within that state in only one year.
 
Estimating the value of the labour of one man at twenty cents per Day, the whole amount which has been realized by your memorialist for his invention is not equal to the value of the labour saved in one hour by his machines, now in use, in the U[nited] States.
 
Permit your memorialist further to remark that by far the greatest part of the cotton raised in the United States has been & must of necessity continue to be the Green Seed. That, before the invention of your memorialist, the value of this species of cotton after it was cleaned was not equal to the expense of cleaning it. That since the cultivation of this species has been a great

source of wealth to the community & of riches to thousands of her citizens. That as a labour-saving machine it is an invention which enables one man to perform in a given time that which would require a thousand men without its aid to perform in the same time. In short that it furnished to the whole family of mankind the means of procuring the article of cotton, that important raw material, which constitutes a great part of their clothing at a much cheaper rate.
 
Your memorialist begs leave further to state that a confident expectation that his case would be embraced in the general law which Congress has for several years had under its ideation, has prevented his making an earlier application. That the expenses incurred by him in making and introducing this useful improvement and establishing his claim to its invention, have absorbed great proportion of what he has received, from those states with which he has made a compromise.

That he humbly conceives himself fairly entitled to a further remuneration from his Country—and that he ought to be admitted to a more liberal participation with his fellow citizens, in the benefits of his invention.
 
He therefore prays your Honourable Body to take his case into consideration and authorize the renewal of his Patent or grant such other relief, as Congress in their wisdom and their justice may deem meet and proper.

An excerpt from an 1898 book about cotton that details the invention of the saw gin and the ginning and baling processes.

In this section of his book, *Cotton: Its Uses, Varieties, Fibre structure, Cultivation, and Preparation for the Market*, Christopher Brooks explains the stages of cotton harvesting and processing before its sale at market. This excerpt includes an illustration of an antebellum gin house.

This advertisement promotes cotton gin equipment for sale by the Albany Cotton Gin Manufacturing Company located in Albany, New York. It is part of a larger circular from the company advertising other agricultural equipment. Text persuading the reader of the product’s merits underscores some of the health risks people had come to associate with cotton ginning.

This map plots the percentage of enslaved people by county for the southern states based on census data from 1860. The darker counties have higher percentages of enslaved people within the overall population. The map also includes a chart at the bottom with data from the 1860 census that lists free and enslaved populations for each of the southern states. This map was sold during the Civil War and was one the first statistical or thematic maps published in the United States. Although not explicitly acknowledged on the map, it was produced by the US Coast Survey.

The slave auction described in this broadside was for enslaved people from St. Johns Berkeley in South Carolina, and it was held at the slave mart on Chalmers Street in Charleston by brokers P.J. Porcher and Baya. The second page of the broadside lists the names and ages of the men, women, and children for sale. For some, it also notes previous experiences, skills, and health conditions.

Areas could include coastal South Carolina, the Alabama Black Belt, the Mississippi River Valley, and coastal Texas. Once students have made a list of areas of concentration, divide them into small groups and assign each group one area. Ask each group to research the history of cotton production, slavery, and the cotton gin in that area, create a map of the area, build a timeline of major milestones, and present their findings to the class.
2. *Research extension:* Eli Whitney created an early model for the cotton gin but many future inventors improved on it with the addition of features like steam power. Ask students to individually find a diagram of a post-1860 cotton gin model and present a comparison with [Eli Whitney’s cotton gin model](https://dp.la/primary-source-sets/cotton-gin-and-the-expansion-of-slavery/sources/1874) by annotating the images with at least five comparisons or contrasts.
3. *Historical connections:* Some historians have argued that Eli Whitney’s invention of the cotton gin was a significant cause of the Civil War. Ask students to write a position paper that takes a stand on this claim, using additional research or prior knowledge of the causes of the Civil War.

Overview

In 1792, recent college graduate Eli Whitney moved to Georgia to work as a tutor on a plantation. There, Whitney learned that southern planters were eager to make cotton a profitable crop. Once cotton was picked from the field, seeds had to be removed from the cotton fiber by hand before cotton could be sold. This process was labor-intensive and time-consuming, and it limited the amount of cotton that planters, relying on the work of enslaved people, could produce. 

In 1793, Whitney invented and submitted a patent for the cotton gin—a machine that used rotating brushes and teeth to remove seeds from cotton fiber. His invention revolutionized cotton production, although Whitney faced challenges enforcing his patent and saw little profit from it. While an enslaved person needed about ten hours to separate the seeds from one pound of cotton fiber by hand, two people using the cotton gin could produce about fifty pounds of cotton in the same timeframe. 

The invention of the cotton gin forever altered the economy, geography, and politics of the United States. The cotton gin made cotton tremendously profitable, which encouraged westward migration to new areas of the US South to grow more cotton. The number of enslaved people rose with the increase in cotton production, from 700,000 in 1790 to over three million by 1850. By mid-century, the southern states were responsible for seventy-five percent of the world's cotton, most of which was shipped to New England or England, where it was made into cloth. Whitney’s cotton gin and its descendants helped the southern states become a major agricultural force in the world economy on the backs of a growing enslaved population. 

After the Civil War, cotton production boomed, as many newly emancipated African Americans continued to work in cotton fields as sharecroppers—tenants who rented land from farmers in return for a share of the crops harvested from that land. In the sharecropping system, landowners often cheated tenants using financial deception reinforced by racial violence to keep sharecroppers working to pay off endless debt. By the 1950s, mechanized cotton pickers had largely replaced manual cotton picking, but modern versions of the cotton gin are still in use today.
