Overview

The legal and policy workstream members agreed that a significant challenge for the DPLA would be balancing legal risks with building a broad collection of works and enabling experiments in access. Among the issues considered were orphan works, international access, privacy, and digital lending.

In line with the workstream’s desire to support experimentation, members present decided that, while the scope of the DPLA is still taking shape, the best course of action would be to provide information as needed, including best practices and pointers to existing analyses. In this spirit, those members crafted the following draft mission statement: “The DPLA legal and policy workstream will illuminate legal issues and, where feasible, provide information and options for addressing legal issues for America’s libraries as they go digital.”

With this mission statement in mind, the workstream plans to coordinate with the five other workstreams to identify the potential and immediate legal issues and to aid in the establishment of best practices, guidelines, and various policies for the DPLA. In addition, the workstream hopes to hold several collaborative workshops with other workstreams on issues such as orphan works, licensing and authorization practices, access to works for the disabled, and common policy questions encountered in the field.
